Mr Lynch having opened the case for the defence, called the ' following evidence : — Anthony Gin : I am a miner living in Beefton, and recollect meeting Roulston on the Saturday night : I asked him if he had 250 Golden Treasures for sale at 6a 6d, and he said he had only got 100, I told him 100 would not do for me. I wanted 250 ; he asked me to wait until 8 or 9 o'clock in the evening, and he would procure the 250. Saw him at that hour, and he said he could not get them. He asked me to wait till Monday, but I told him I would not, and that he need not bother himself further about the matter. He asked me to buy 50 Darks at 345., but I told him I would not until I saw the mine. On the Tuesday following, I saw him again, and he told me that he had bought 250 Treasures and 50 Darks. I told him he had done so without my order. I said, however, that I did not care that I would take the 50 Darks, but he refused to let met have them unless I took the lot. After I got the summons, I saw Mr Bowman,and told him thatl was a foreigner, and that rather than go to Court I would make him a present of £10. Am quite clear that I told Roulston that I should have the shares en the Saturday night. By Mr Jones : lam sure Roulston did not offer me the 250 Treasures on Saturday night.
