RESIDENT MAGISTRATE'S COURT.
Thursday > ovember 14th 1882. (Before W. H. Hevoll Esq., R.M.) Smith and Barkley v. Foy. Claim for £5 12s 6d, for goods sold and delivered to men employed on the survey staff. Mr Boase, in the employ of the firm, was called and proved that the two survey hands called at the shop and asked to be supplied with certain goods. They were told that they would have to get someone to guarantee the credit, and they shortly afterwards returned in company with urFoy who said he would see the account paid at the end of the month. The goods were then supplied land at the end of ike month made Inquiries and found that the amount had not been deducted from their wages. Accordingly Mr i- oy was applied to and he repudiated all responsibility in the matter. The defendant denied that he gave the firm any guarantee or anything that could be construed into an authority. He merely went to the shop with one of the men, according to request and stated that the mmi were in his employ and would receive there wages at the end of the month, had no idea of taking upon himself any responsibility in the matter. ,he Magistrate said that the fact that the entfie^ in the book were in defendants najne and that the goods could not be supplied until he attended went to| show that the plaintiff clearly held defendant responsible. Judgment for .^plaintiff for amount claimed. i
