Tuesday, January lGth, 1883. (Before W. H. Revell Esq. E.M). HOCiAN V. HOLLYWOOD. Tins was an information charging defendant with using insulting *and abusive language towards complainant at Soldier's Creek, on the lOfch Jan., and praying that defendant might bo bound over to keep the peace. Denis Hogan ; On the Bth inst., I posted a notice for a tunnel at Soldier's when defendant came up and called me a robber and a thief and raised a shovel to strike me with it. He said he would have my life, and also threatened to knock my b eye out. By the bouch ; I am not frightened of my life, but am in dread that he will do mo some serious injury if he catches me undergromid. • By defendant ; I did peg out your claim, wash dirt, paddock, races, tunnel, boxes &c. I don't claim your boxes and wash dirt. I believe you are working there twelve months. I went into your tunnel in your absence. I have no hut there. You never challenged me for going into your tunnel. I know nothing of your dish and bucket. William Lynch ; I . was on the ground on the day in : question, and both were pretty excited and had some words and I went between them. Defendant said something about striking Hogan with a shovel. By defendant; Don't think complainant had any stones in his hands. Heard complainant order yon out of the tunnel. i James Hollywcll ; I am working ' | there 12 months, and as soen as I had I goo everything in working order Hogan came and jumped everything. Ho was continually about the claim aud I lost several things from it. I was excited when he came on the morning in question, aud may have threatened bin if he did not clear out, as he came there to rob me of all my labor. This closed the case. Information dismissed. LIDDICOAT V. HARRIS. This was an information for assault, in which there was a cross action for the same offence. Case withdrawn by mutual consent. SAVAGE V. CLIFFORD. An information charging defendant with assult on the 12th December, at Reefton. Mr Jones appeared for complainant, and Mr Lynch for the defence. Robert Savage; I am a mining speculator residing in Reefton, on the 12th Djcembe'r, at about past 7 in the evening I was standing at Dawson's front door with both hands in my pockets when defendant rushed up to me aud said something in an indistinct voice aud before I could take my hands out of. my pockets he struck me several times on the side of the face with his shut fist. I caught hold of him by the beard. I felt immediately that my jaw-bone was broken as I could scarcely move the side of my face. I went to Dr Thorpe immediately and was spitting blood for several days after. By the Bench : He struck me two or three blows before I could get my \ hands out of my pocket. • ! Henry Stanley Thorpe : lam a legally qualified medical practitioner, residing at Reefton, and know the complainant as also the defendant, recollect complainant calling on me on the day in question. He said he had had , a very severe blow on the face and I examined him and found one of the bones on the left side of the face dislocated, next day there was a slight dent on tLe left side of the face. On the 13th again saw complainant and found that he was suftering from internal hemorrhage, attended him for three days after that. By the Bench : Complainant will always have a slight dent in the face as the result of the injury. I did not set the bone as it was impossible to do so. William Faler : I am a journalist residing in Reefton and know both parties to this action. About «i month ago I was standing near Dawson's Hotel talking to Mr Clifford and others. Mr Clifford "left us, and immediately after, I heard a slight scuffle in the lobby of the hall. For a moment or two I took no notice of it, and upon going in through the bar I saw the complainant and defendant scuttling. This closed the case for the complainant. Defendant reserved his defence and was committed for trial attlin next sitting of the Tistrict Court to be held on Monday next, b;>il being allowed, defendant in £50 and two sureties of £23 each.
