Patrick Brennan : lam County Chairman of Inangahua. The Council hold a miners right. I know that the New Zealand Antimony Company have applied for a water-race in Auld's Creek, but nothing since has been done in the matter, ihe Council purpose to obtain a water supply from the same creek, about half a mile up from its junction with the Inangahua river. Granted. BATT V. WELCOME COMPANY. Application for cancellation of certificate of tailings site at Capleston. Mr Lynch appeared for the defence. John Batt— The company have held the site since the sth November, 1881, and have never done anything to utilise it. The ground is described as being near Rogers' bridge : they hold another special si to of live acres near their battexy, ! and that ha 3 never been utilised. I have I applied for it as the only level piece of ground at Boatman's to build upon. They have eleven berdans and two pans at I the battery, and I do not think that they have any right to the lower site. Mr Lynch said, that the ground waa held bona fide, and that ever siuce it waa taken up tho company had been getting everything in readiness to use it. He called. Patrick Brenuan : I am manager of the Welcome Company, and I know the special site app ied for by Batt ; the company have been getting berdans, but they have not yet been thoroughly completed. j The ground in question was applied for to store tailings on. The company have another site for stacking tailings, but only a very small piece of it is of any use for the purpose, as it was only a short time j ago that a flood came down the creek and swept away a large quantity of the tailings. The company sent away to Melbounib last week for a tailings pump ; the grouiid is held under a certificate. By Applicant : lam certain that after the tailings have been treated by thirteen berdans they will be treated again on the site in question. There is a large quantity of gold which cannot be extracted by berdans, and it is only by exposure to the atmosphere that the gold can be released. T. M'Laughlin, a director of the company, was called, and stated that the company had received an offer of 10 per cent, for the tailings after they had gone through the thirteen berdans. Application refused. The Court then adjourned.
