WARDEN'S COURT.
+ (Before Mr W.vnDEx Keddell). Friday, Sept. 2nd, 1885, Francis v. Result Gold Mixing Co Aciion praying forfeituie of special claim. Mr M'lynihan for plaintiff. G. C. Bowman, lejjal manager, and A. Kater, a director, wished to appear for defendant company, hot the Warden held that the company eonld only appear l>y solicitor, or by nn ajjent appointed under the seal of the company npproved of l»y theWardfti. Ho therefore held there was no appearance Mr Moynihtui called witnesses who proved that the rent was two years in I urrear, and that the company had not fulfilled the covenants of the giant. The Warden, after consideration, held that he could not entertain the suit in its present form. He pointed out that under the Mines Act, 1877, no regulations had been made as to special claims, and he held tliut he had no jurisdiction. He said, however, that if Mr Moyiiihun would write him a letter setting out the facts he would forward the same to the Government, and would recommend the cancellation. The Court then adjourned.
