Hawkins, with using language calculated : to provoke a breach of the peace.; ,The words sworn to m the-ju-formation were, , " You . comtemptible dog. Why. do you dog me. You puny whippersuapper,'' also threatening to strike the complainant; a '.'*' Mr G.F V Hawkins appeared, for* com- ' plainant, and Mr Hankins for defendant. The complainant stated : that the language complained of was used on the 7th; of December, Awhen heiAwent'Ato Foxton on important business, which require^ the assistance iof- a LNatiVe inte^ppl-er and J.P. Afterwards defendant said " I'm 'hot ; going, to v be Jumped . on by* ; a c^ntpjmptilile .dog Alike; you.- Take "care or yo.u'li X, -fiuU, font, who you are talking : *to,"at the same time making at .gesture, as if. to strike witness.; Tyitness gave defendant no provocation, but treated -him courteously. Mr JSaker .also gave evidence m corroboration. ■ ■•... -■■■>■■ ■- Defendant denied the use of the;language, or. threatening .to commit a ; breach of the peace, but admitted he might have used the words to Mr Baker within hearing of complainant. ...The Bench said that defendant >mi^ht havo thought he had some slight ; p^vocation. The case could not be dismissed as defendant had no right, to usei suofr contemptuous language, ; as such was equivalent to committing a i breach of the peace.
