Most of the Articles settled on his wife were wedding presents. He gave an absolute Tsale note of goods m the brewery to Messrs Stevens and Gorton, which they, got possession of. A horse and cart were inadvertently omitted from the note and were subsequently sold among other things m the brewery to MrOlttvierandweretakenpossessionby Ihim. FeihUug Borough Council. • ' Mr Shaw made application for a rehearing of this case,. in which the plaintiff had been non-suited; the ground of tbe application being that the Judge had mis directed the jury. He (Mr Shaw) submitted that the
question whether there was any evidence of negligence on the part of the dofendant was a question for the jury. He was aware that the present application should properly be made ac the next sitting of the Court, but hi* hardly thought that counsel for defendant would object that hi* Honor should hear the question discussed on its merits to-morrow. His Honor said he was quite willing to sit to-morrow. Mr Hankins said he must object to j the question being discussed to-mor-row. Mr Shaw said m that case there was an end of it for the present. [We will give the arguments on each side m extenso m to morrow's issue. The Court then adjourned till next court day.
