LIBEL ACTION.
MR ELLIOTT WITHDRAWS CLAIM SMALL COSTS ALLOWED'. (Per Press Association.) WELLINGTON, Dec. 9. Arising out of certain allegations in an ' open letter that appeared in the Critic; Mr Howard Elliott filed a claim in the Magistrate’s Court recently to recover £2OO damages, libel, on the ground, chiefly, that the letter implied that he carried an automatic in his pocket. When the case was mentioned today before Mr Riddell, S.M., counsel for defendants said that Mr Elliott had filed notice of discontinuance. The defendants had applied to have the matter dealt with in the' Supreme Court, so that the.truth or otherwise of the allegations cou)d be ascertained. Defendants asked for substantial costs, considerable trouble having been gone to in preparing the defence. This was opposed by Mr Boys, who appeared for Mr Elliott, saying that liis client was prepared to pay a reasonable amount in view of the fact that he had the action discontinued. Riddell allowed £3 3s costs.
