A BETTING TRANSACTION.

CIVIL CLAIM DISMISSED. CASE HEARD AT HAMILTON. HAMILTON, Dec. 8. In the Magistrate’s Court at Hamilton R. G. Aitken, saddler, of Frankton, sought to recover from F. M. Campbell £24, the amount of a cheque which had not been met owing, it was alleged, to tho drawer’s account having been closed when it was presented. Plaintiff stated tlrat defendant had asked him to cash the cheque, to enable him to proceed to Kawliia. On presenting the cheque plaintiff lound that defendant’s account had been closed. Defendant claimed that the cheque represented a bet which was canvr.’lcd tho following morning. The magistrate, Mr Wyvern "V'dson, held that the transaction was a betting one and plaintiff was not entitled to recover. Judgment was entered for defendant with £5 8s 2d costs.
