CHARGE DISMISSED.
MOTORIST NOT TO BLAME. Per Press Association. WELLINGTON, Sept. 18. The charge against Frederick Charles Facer of having negligently driven a motor car on the main road, Upper Hutt, on August 10 last, so as to cause the death of Mrs Florence Alton, aged 63 (by knocking her down) was dismissed by Mr E. Page, S.M., who held that the evidence for the prosecution was such that no jury would convict. He did not call for evidence for defendant. Deceased and her sister were walking home along--tho side of the bitumen track when Mr Facer’s car pulled out from behind another car to pass it. The time was between lights. Deceased was wearing a dark dress, making it difficult for the lights of Mr Facer’s car to render her visible. Deceased had got almost home. She was killed instantly.
