FULL COURT APPEAL

LOCAL GRASS PLOTS BY-LAW. TESTING OF VALIDITY. Advice was received by the Palmerston North City Council last evening from the Municipal Association of New Zealand intimating that, at a recent meeting of the executive, it was decjded that as the question of protection of grass plots in the streets was one of great importance, the City Council be recommended that the apEeal against the decision of Mr J. i. Stout, S.M. (upholding the City Council’s by-law) should be heard before the Full Court in Wellington and, if agreed to, the association wouid make available the services of its counsel, to argue the case. The association, however, would not, in the event of the appeal being successful, be responsible for the costs of such appeal. It was decided that the cit->" solicitors be instructed to undertake the necessary legal work in connection with the case and that the Municipal Association’s solicitor be asked to defend the case before the Full Court in Wellington.
