In pursuance of the provisions contained m "The Counties A^t Amendment Act, 18S0. the Pountr Council for the County oF Afnnnwatu. m tlie Provim-i* 1 "District °f in tie Provincial District of Wellington nrA Colony of New Zealand, hereby give notice that they are prepared to receive tenders from persons willing to become lessees of the ferries over the Manawatu Biver at. Foxton and at the Lowpr Gorge (the lease of the Foxton ferry to include the Foxton public pound, with the rights and- appurtenances thereto belonging), together with all buildings, gear, boats, punts, and all other appliances and ap. purtenances whatsoever to the said ferries respectively belonging or appertaining. And that the proposed terms and conditions of 'such lease! are an follows :— Each lease shall be for a terra of 7 years, c'ompntsd from the 31 st day of March, 1881, and shall contain the usual covenants— for payment of rent quarterly m advance, the first payment to be made on the execution of the lease ; for payment of all rates and taxe?-; for keeping the demised premises m repair ; and for the insurance of the same m the full value thereof; also ji covenant that the lessee shall use and work the ferry m a proper manner and abide by and confirm to all laws now m force, or which may dnnng the continuance of the lease be m force relating to public ferries ; nnd also a pro. visio for re-entry by the lessors (with full power to enter upon and take possession of the demiseo* premises, and of the punts, gear, and all other appliances of or belonging to the ferry, and to ■work the ferry at the expense of tre the lessee or his sureties), on nonpay»*e"til;''df rent within 8 days after it becomes due ; or on the breach or non-per-fqrma'nce oF any of the lessee's covenants ; or on his doing nny act contrary to the laws of New Zealand relating to ferries ; or on his becoming bankrupt, insolvent, a lnnatic, or dying or otherwise becoming incapable of managing, or neglecting properly tn manage and conduct the ferry. And also a covenant not to assign the lease, or underlet the ferry, without the consent m writing of the lessees. Kach lease shall also contain the following covenants, provisos, conditions and agreements, that is to say : 1. That the.lessee shall provide at his own expense all g<»ar. boats, punts, and mat rials, not m laded m the lease, •which m the opinion of the lessors or their engineer shall be necessary for the 'effiVipnt working of the ferry, and shall prey'd 1 at his own expense all reqrisite assistance, and also such lights to be placed m such positions, and to be kept burning during such hours as the lessees or their engi neer shall direct. 2. That the lessee shall keep m thorough repair and condition to the satisfaction of the lessors, or their engineer the approaches to the ferry on DOth sides of the river as follows, that is to say — ihe approaches to the Lower Gorge Ferry from the gate on the east side of' the river to the punt, and on the ■frest side of ihe river from the County metalled road to the punt, and the approiCcnesto the Foxtoh ferry from Burr's corner to the punt, and from the punt on the south side of the river to the sea beach; and keep all sand cuttings cleaned out arid slopes .scrubbed where the lessors or their engineer direct. 3. That the lessors, or their servants or officers, shall be all times: during the continuance of the lease at liberty to ' enter upon the demised premises, and inspect the working of the" ferry, and the appliances thereto ; and the lessee shall at his own expense carry out any alterations or instructions as to the working or management of the ferry as the lessees or their officer shall direct 4. That all "punts, boats, gear, and material* provided by tlie lessee during the continuance of the lease shall be deemed to be the property of the lessors. AH such property which shall be included m the lease shall be valued upon the lessee entering into possession and the same together with any additional plant, boats, gear, punts, or other materials supplied by the lessee shall, upon the expiration or other sooner derermi.pation of the lease be again valued, and •if the value of the whole of such property shall then be m excess of that whichis included m the lease, the leßsors shall paj the amount of such c - cess tc the lessee ; but if the whole of such property shall, on the determination of the. lease be of less value (after allowing for reasonable wear and tear) than, that included m the lease, the lessee or his sureties shall pay to the lessors the difference between such values. "~ ""■ 4a. '%That the lessee and his sureties shall hold the lessors harmless and indemnified from and against any clain-s for compensation made by any person or persdhsTiyreason of any loss, carriage, or personal injury sustained by him or . them, or his or. their goods and chattels, m consequence of r the negligence of the lessee or his servants m the proper management and working of the ferry or otherwise ; and also against all damages, costs, charges, and expenses ; .^hich. the lessors may sustain or be put to m any Court of law or otherwise with reference to such claims. The lease of the Foxton Ferry and Pound shall contain the following additional covenants and provisos naiiJ.ely :— : . 'B. .'That the lessee shall keep m "thorough repair to the satisfaction of the lessors or their engineer the whole of the fences around the cattle paddock, and all other fences around the ferry property which lead to the punt and the yard near the punt. 6. That the lessee shall m keeping and conducting the Foxton pound conform to all the provisions of the Impounding Act now m force and of any ' other laws relating to public pounds 'which are, now or may be m force during the continuance of the lease, and ; shall keep m good repair a»d renew if necessary the fencing of the said . pound and the paddock thereto belonging.' 7. That the lessors shall be at liberty to remove the ferry to any part of the rive* to a distance not excepding 5 miles m a straight line from the prevent ferry, and the' lessee shall have no claim against the lessors for any com-
