Act. 18R0. the Pnnnty Council for tlif tVmntv of " m the p.-nvi'x-h 1 D'sfriet of Mamwatu, m the P < vincial Distnct of Wellington and C -lony of New Zealand, hereby give noi)pp thnf they fire prepared to receive tenders from persons willing to become Icssef-sof the ferries over the Msnawatu Eiver at Foxton and at the Lower Gorge (the lease of the Foxton ferry to include the Foxton public pound, with the rights and appurtenances, thereto belonging), together with all biiildinsrs. gear, boats, punts, and all other appliances and appurtennnee«! whatsoever to the said ferries respectively- belonging or appertaining. And that the proposed terms and conditions of such leases are as follows : — Each lease shall be for a term of 7 years," cnmTmtad from the 31st day of March, 1831., and shall contain the nswal covenants — for payment of rent quarterly m advance, the first payment to be made' on the execution of the lease ; for payment of all rates and taxes ; for keeping the demised premises m repair ; and for the insurance of the same m the full value thereof; si'so a covenant .thai the lessee shall use and work the ferry m a proper manner and abide by and confirm to all laws now m force, or which may during the continuance of the lease be m force relating to public ferries ; and also a provisio for re-entry by, the lessors (with full power to .enter upon and take possession of the demised premises, and of the punts, gear, and all other appliances of or belonging to the ferry, and to work the ferry at. the expense of tl - e the lessee or bis sureties), on nonpayisent of rent within 8 days after it becomes due ; or on tbe breach or non-per-formance of any of the lessee's coTenants; or on bis doing nny act contrary to the laws of New Zealand relating to ferries ; or on his • becoming bankrupt, insolvent, a lunatic, or dying or otherwise becoming incapable of managing, or, neglecting properly to manage and condnct the ferry. And also a covenant not to assign the lease, or underlet the Ferry, without tbe consent m writing .'of. the lessees. Each lease shall also contain tbe following .covenants, preyißos, conditions and agreements, that is to say : 1. That the lessee shall provide at his own expense jllgparV. boats, -punts, and mat rials, nrifc m.lnded m the lease, ■which m the opinion of the lessors or their engineer shall be necessary for the efficient-working of the ferry, and shall prov'de. at his own expense all requisite assistance, and also such lights to be placed m sugh position s,, and to be kept burning during such hours as tha lessees or their engineer shall direct. 2. That the lessee shall keep m thorough repair and condition to the satisfaction of the lessors, or their engineer the approaches to the ferry on both si des of the river as follows, that is to say— the approaches to the Lower Gorge Ferry from the gate on the east side of the river to the punt, and on the west side of the river from the County metalled road to, the punt, and the approaches to tbe Eoxten ferry from Burr's corner to the punt, and from the punt on the south, side of the river to the sea beach, and keep all sand cuttings cleaned out and slopes scrubbed where the lessors or tbeir engineer direct. 3> That the.lessors, or their servants or. officers, shall be all times during tbe continuance' of the lfiase at liberty to enter upon the demised premises, and inspect the, working of "the ferry, and the appliances tbpreto; and the lessee shall ftt£his ; own expense carry out any alterations or instructions as to the working or management of the ferry as the lessees or their officer shall direct 4. TKat all punts, boats, gear, and materials 'provided by the lessee during the continuance of the lease shall be deemed;to be the property of the lessors. AH sucb property which shall be included m the lea sq shal.l.be valued upon the lessee entering info possession and the same together ; witb any additional plant, boats, gear, punts, or other materials supplied. by tlielessee shall, upon the expiuation or other sooner determination of tbe lease b* again valued, and if the value ! dft)in whole of such property shalbthen' be m excess of- that which is included m the lease, Hie lessors shall $a>j tb.e amount of snch excess tc the lessee ; but if the whole of such property shall, on the determination of the Tease* be of less valne (after allowin^for reasonable' wear and tear) than that included m the lease, tbe lessee or bin sureties shall pay to the lessors the difference between such values. • ir ' 4a. That tbe lessee and bis sureties shall bold the lessors harmless and indemnified from and; against any claims for compensation -niade^ by any person or persons byreason of any loss,"carriage, or personaLinfury sustained by him or them, or his or'their goods and chattels, m consequence of~th&negligence-of the lessee or his servants m the proper management and working of the ferry or otherwise; and also against' all damages, costs, charges, and expenses which the lessors may sustain or'_be put to m any Court of law or otherwise with reference to such claims. The lease of the^Fjoxton Ferry and Pound shall contain the follojwing additional^ cpvenantg ' and provisos namely-:— -y v V ■ : 5.
