CIVIL CASES.
George Theak T. W. H. Flyger.— Claim, £1 Is 3d, balance of an account for some fruit trees. There was no appearance of defendant, and judgment was given for amount claimed. F. J. Collins v. Waller Baker, jun.— Claim, £7 2s being £5 for breaking in a horse, 16a for two pets of shoes, and the balance for depasturing the animal. Mr Hawkins appeared for plaintiff; and Mr Maclean, for defendant. Counsel for the defence raised two objection tit tlie outset — one that the bill of particulars of somewhat mysterious ; the other t hat the defendant was a minor. With regard to the first, the Bench gave leave to amend ; and Mr Maclean waived the point of las client being a minor The whole case hinged upon two points : — First whether there was an ntrreement between the parties that plaintiff should have the use of the horse for four months, on conditions of his breaking it in ; and the second whel'ier in doing so plaintiff nnd worked the animal in an unGt state. The case occupied n considerable portion of day and much evidence was taken on both sides, most of which, however, was contradictory. Judgment was given for defendant. Thomas Q-oodisson v. G-uerin and M'Ghuley. — Claim, £10, being the price of a horse sold by defendants, poundkeepers at Foxton, winch had been wrongly described in advertisement previous to sale. Mr. Hawkins represented the plaintiff. Judgment by consent for £10, to be reduced to £3 upon tho return of the horse. Q-eorge Eldersaw v. John Powell.— Claim £5 12s. 3d. Defendant was not represented and it was ordered that the amount should be paid forthwith ; in default ten days' imprisonment in Hokitika Gaol. Thomas Nelson v. A. H. Stevens.— Claim, £3 193. lid. Judgment by default. J. Heaton v-. C. Walker.— Claim, £6 lla. 6d. Judgment by consent.
