Estate of G. W. Shailer.
A meeting of creditors m the above was held last Thursday, when there were present the debtor and hia solicitor, Mr Hawkins, and the following creditors, R. Leary, L 5 14s 9dJ. P. Leary (by prory) 16s 6d ; Tinsey Bros, L 6; Gk W. Russell, Lll 12s ; Bentley Bros. L 2 12s 6d. Mr Russell was voted to the chair. The debtor being sworn stated as follows : — I have been m. business since August, 1882. Bought what was connected with the business from Kirk wood. Did not pay him m full at the time. PaidL3o for plant, but have not all of it m my possession, part such as plates and material, having been used. I assigned m Feilding just beford coming here. Had nothing when I came, and have kept a full record of takings which amount to about Ll5O. The house and land <>re mortgaged to Building Society. Arranged with Mr Linton that he was to transact my business, receive the money, buy the land and put up the house, and the LBO to him is to cover what was not raised. I have* not handled any of the moneyPainting was not m the contract;. The second mortgage was promised at the first, but was not signed vi i« til about two or three months agjo. Had statement and full adjustment with Mr Linton about three saont ha ago and signed the mortgage. I could not then have paid every bodly without time. I paid £8 5s 8d per month to the Building Society and have been paying this since December. lam about two months ira arrears. Times have been bad, and we have had a long winter, and I have been compelled to file through, creditors pressing. I promised to> Eiy Messrs Russell, Holland and oudon. Consider I was justified m building a house on borrowed money -with the small business I had. I could not foreee everything-, I have about three plates left. Have* reduced Btiilding Society's mortgage) by the monthly payments. Ha¥» collected my accounts pretty well within the last few months, but hare had no large sums lately. About the 20th October had £6, and I filed on the 80th. Wit> a this £6 I took the preliminary steps of filing. I paid no deposit on purchasing the land from Mr Linton. My wife iB m very bad health and I have ten children. I have no account from the doctov. Holland, of Feilding put m a distre»s warrant. He ia one of those persons who consented to sign a document but failed to do so when called upon ; also Lowdon, whose letter I have put m. The Feilding people have had 20s m the £. Have no doubt that with fair weather I could have paid ererything had I not been pressed as 1 have said. On the motion of Mr Leary se« conded by Mr Bentley, the meeting declined to appoint a Trustee.
