Court Over-rules Utilities Tax Plan

“LIBERALS” IN MINORITY WASHINGTON, Feb. 1. A decision which may reflect the attitude of the Supremo Court to President Roosevelt’s contemplated regulations for the control of public utilities was

given by tho Court to-day. By five judgments to four, it held that the tax of ono-tenth of ono per cent, on tho gross income of public utilities, imposed by the State of Washington, was unconstitutional. Tho four so-called “Liberals” of the Bench, Justices Hughes, Stone, Brandeis and Cardoza, formed the minority. The State had imposed the tax to defray the expenses of tho Public Works, department, which regulates the utilities.
