WELLINGTON, Feb. 19
Mr Justice Chapman delivered judgment to-day in an appeal by the police against the Magistrate's decision in dismissing a charge of permitting drunkenness against Christopher Jansen, the licensee of the Wellington hotel. Jansen was a-way at the time, and it was held by the Magistrate that he was not responsible for the wrongful acts of the barman. In his judgment his Honour took the opposite view and held that the publican's authority was delegated to his barman. He upheld the appeal and remitted the case to the Magistrate.
