RESIDENT MAGISTRATES' COURT.
Wellington, 16th September, 1858. •I. In >-~I have the honor to transmit for your information, a Resolution passed this day at a meeting of tbe Miigisti-_.es who sat on the late occasion when the case, "Schroder v. Baker" was heard and adjudicated. _ I had not seen the letter In which the resolution refers until the consideration of its contents was hr.w.,ht before the Bench
It seems to tne from the latter paragraph of that letter that you have lost sight of the fact that, I had stated openly in court—the morning that the case was brought on—that, for reasons which I then gave, I sliould summon a Bench of Magistrates to adjudicate upon the case. The Magistrates who attended, were all with one exception (and the exception aiose from my being unaware of the. gentleman .-presence in town) summoned by me. Had the case been adjaurned to another period, instead of to one o'clock of the day in question, I should have summoned all the magistrates of the district, but time permitted die meeting of such gentlemen only who were accessible at a short notice.

It was resolved—"That a letter having appeared in the Wellington Independent of 11th September, instant, signed by John King, containing imputation., on the judicial conduct of members of the Bench, fur which there is no foundation whatever, the Bach of Magistrates call upon Mr. King to withdraw and apologize for the same"

Sin, —I have the honor to acknowledge the reciipt of■■ your letter, dated 16th instant, enclosing Resolution passed by the Magistrates who sat iv the case of Schroder v. Baker, in the Resident Magistrates' Court, calling upon me to withdraw and upoligize for a certain letter written by me in the Independent, ofthe 11th instant, and which the Magistrates- considered contained an imputation on their official conduct. I beg to inform you Ihat I had no intention whatever nf imputing any improper conduct to the magistrates silting on the case. I was under the impression when 1 wrote such letter that certain of the magistrates hud been invit-d lo attend the hearing at the request of complainant or of some one oo his behalf—and if you recollect Mr. Travcrs stated on tho first adjournment of the case, that from what he had been informed he expected a Bench of Magistrates there, and made a retnaik which led me tv suppose that such magistrates had beeu invited to attend on behalf of Mr. Schroder, as none had been iuvited by or on behalf of Mr. Baker.

Letter from Mr. King. Solicitor, in reply to the Resolution of the Bench ou the 16tb ult., forwarded him by the Resident Magistrate having been read—
Resolved—"That tho correspondence and resolution with reference to Mr. King's letter in tbe Wellington Independent of the 11th September last bn forwarded to the local papers with a request that the same may lie published."
