NATIVE LAND COURTS, MAORI LAND BOARDS, AND NATIVE LAND PURCHASE BOARD (REPORT FROM THE UNDER SECRETARY, NATIVE DEPARTMENT, ON THE WORKING OF) FOR THE YEAR ENDED 31st MARCH, 1920.

Sir,— Native Department, Wellington, 30th July, 1920. I have the honour to submit the annual report on the work of the Native Land Courts, Maori Land Boards, and the Native Land Purchase Board for the year ended 31st March, 1920. The Hon. the Native Minister. C. B. Jordan, Under-Secretary. ANNUAL REPORT. Native Land Court and Native Appellate Court. The Native Land Courts held 169 sittings during the year. The total number of cases notified for hearing was 28,954, and 13,399 cases were dealt with. Native Freehold Land. —904 partition orders, affecting 358,791 acres, were made, and 8,511 succession orders and 2,386 other orders affecting Native lands were made. The Native Appellate Court held sixteen sittings during the year. The total number of cases scheduled was 251, and 203 cases were dealt with. The Court fees received amounted to £5,994 95., as against £4,208 12s. 9d. for last year. Maori Land Boards. Vested Lands. —The area of land vested in and administered by the various Maori Land Boards at 31st March, 1920, was 942,632 acres. During the year 1,021 acres were alienated by way of lease, and 711 acres 1 rood 5 perches were revested in the Native owners. The area vested in the Maori Land Boards since their inception has been 728,579 acres 3 roods 35 perches, viz. : Under Part XIV, 309,846 acres 3 roods 17 perches ; under Part XV, 348,972 acres 3 roods 5 perches ; under special enactments, 69,759 acres 1 rood 13 perches. In addition an area of 214,052 acres 3 roods 31 perches has been declared subject to the provisions of Part XVI of the Native Land Act, 1909, making the total area of 942,632 referred to above. Of the vested lands 137,899 acres have been sold, and 380,032 leased by the Boards, leaving 210,648 acres still undisposed of. Native Freehold Lands. —During the year the Boards have approved of 405 leases, comprising 39,246 acres, and have confirmed 1,248 transfers (apart from sales to the Crown), affecting 103,306 acres. The Boards have also confirmed thirty-two mortgages, affecting 7,436 acres, the total area of land affected being 149,988 acres. The total receipts of the Boards for the year amounted to £526,984 17s. 7d. and the disbursements £471,702 10s. 2d. The total amount at credit of the Boards was £586,317 16s. 7d. Of this sum £479,484 ss. lid. is held on deposit with the Public Trustee in separate accounts in the names of the respective Boards, and £15,400 is vested in War Funds bonds. The balance is held at credit of current accounts of the Boards. The revenue received by the Boards amounted to £9,276 6s. 2d.—-£4,220 Bs. 6d. by fees, and £5,055 17s. Bd. for commission.

Native-land Purchase. During the year 121,176 acres were purchased, and 107 blocks, comprising 75,119 acres, proclaimed Crown lands. The total area of Native lands purchased by the Crown for settlement since 1909 is 1,076,570 acres, and the total amount of purchase-money paid £2,505,473. Thexe being less land available for purchase, the purchases will naturally be less in the future than in the past. Vrewera Reserve. —29,996 aires were purchased during the year, bringing the total area purchased at the 31st March, 1920, to 320,578 acres. The total area of the blocks (forty-four) which are under purchase is 518,329 acres. The following figures will give some idea of the difficulties attending the purchase : The total number of original owners in the blocks under purchase (not including successors) was 14,367 ; the total number of signatures to be obtained to cover all interests (estimated), 17,939 ; the total number of signatures obtained, 10,451 ; the number still to be obtained (which will be increased when further succession orders are made), 7,488. The owners are scattered over a large district and difficult to reach. A large number are non-sellers or unwilling to sell. Nearly two thousand applications for succession had to be lodged and dealt with by the Native Land Court before the purchases could be completed in many cases. It is not surprising, therefore, that progress should have been apparently slow, and the Purchase Officers rather deserve credit in that they have ; been able to acquire so large an area at all. With regard to this district it has been stated in a previous report that those familiar with it know that the bulk of it is very rough, and suitable only for pastoral purposes in large areas requiring the expenditure of much capital, while a considerable area should be permanently reserved for scenic purposes and the preservation of the lakes and forests. This is the position notwithstanding all that has been written and said on the subject. Conversion of West Coast Settlement Leases. —A considerable number (forty-three) of transactions have been completed during the year and the land proclaimed Crown land, which will enable the lessees to obtain the freehold title. In nineteen other cases the purchase of owners' interests have been completed but the necessary partitions have to be made by the Native Land Court before area purchased can be proclaimed. In forty-seven cases purchase is in progress, and in eighty-six cases valuations are being awaited. The total area purchased during the year was 10,001 acres 3 roods 2 perches, and the total amount of purchase-money paid was £107,138 Bs. 9d. This will be recouped in cash by the purchasing lessees when the transactions are completed. It should be noted that the Native Land Purchase Board is only concerned with the purchase of the interests of the Native owners who are willing to sell, and the'land then passes to the Crown Lands Department, which completes the transaction so far as the lessee is concerned. | • Land still held by Maori Owners in the North Island. But of this it is estimated that about 550,000 acres are within the pumice area, and to this probably another 200,000 acres, which includes mountain-tops, springs, sand-dunes, &c, and land unfit for settlement, should be added. This leaves an area of 907,278 acres that may be considered suitable for settlement. This cannot be regarded as an excessive area for the use of the 47,000 Maoris comprising the population of the North Island and their descendants. It is roughly 19 acres per head. Instead, therefore, of there

being a large area, of Native land available for general settlement, it would seem that there is barely sufficient for the requirements of the Natives themselves. Seeing that the Europeans have acquired about 62,000,000 acres of Native land, it might not be thought unreasonable to allow the Native owners to retain the small area remaining to them, for it may safely be said that the lands leased to Europeans will never return to the occupation of the Native owners. The great problem is to get them settled upon their individual holdings ; but this is an object not likely to be fully realized, as all Maoris will not become farmers any more than will all Europeans. The Native Department is sometimes twitted with not publishing figures and making statements in regard to the position of Native lands, but there are ample figures published in the various returns for any one who is intelligent enough to understand them. All the figures and the; statements that can be made will not alter the position, which is that the Maoris have disposed of nearly all the lands that they can dispose of without leaving the bulk of them landless, and later, probably, to become a charge on the State. South Island.- —The total area of land owned by Maoris in the South Island and the Chatham Islands is : South Island, 212,786 acres ; Chatham Islands, 65,725 acres 1 rood 3 perches : total, 278,511 acres 1 rood 3 perches. The land is held as follows : South Island -Leased to Europeans, 35,780 acres ; held by Maori owners, 177,006 acres. Chatham Islands —Leased to Europeans, 9,723 acres 3 roods 37 perches ; held by Maori owners, 56,001 acres 1 rood 6 perches. (Note : The above includes land administered by the Public Trustee.) Departmental. The total expenditure of the Department for the year was £33,096, including £4,638 on account of the Native Land Settlement vote, as against £27,896 for the previous year. The revenue received from all sources amounted to £15,361 17s. 7d. During the year thirteen applicants for Native Interpreters' licenses sat for examination, and five were successful in obtaining first-grade licenses. I regret to have to record the death of the Chief Judge of the Native Land Court, Mr. Jackson Palmer, which occurred in August last. The late Chief Judge possessed a wide experience of the Native land laws and Native matters generally, and his loss will be much felt by the Department. Judge R. N. Jones, the senior Judge of the Native Land Court, was appointed Chief Judge in succession to Judge Palmer; and Mr. H. F. Ayson (who has been acting as Judge of the Cook Islands Land Court) and Mr. F. O. V Acheson were also appointed Judges to fill the vacancies caused by the death of the late Judge Wilson and the resignation of Judge Jack. I desire to thank the members of the staffs of the various offices for the manner in which their duties have been carried out during the year.
