Appeal No. B. —ln regard to the list of names of seven persons submitted by Kareko Whakaki for inclusion in the Oputea portion of this block for a total interest of fifty-five shares, there being no objectors, we recommend that the said seven names, with the shares asked for each of them respectively, be added to the list of owners as for the Oputea piece only. Appeal No. s. —ln regard to the claim by Matiu te Kurapa and Te Mauniko Matiu for the inclusion of their two names in the order with an interest of seven shares between them for the Tiritiri portion of the block there being no objectors, we recommend that their names and shares be so added to the list of owners as for the Tiritiri portion only. Appeal No. 10. —In regard to the claim for the inclusion of the names of the ten persons commencing with the name of Paora Hiki and ending with the name of Maria Tote, with a total interest of forty-eight shares amongst them, in the main Hikurangi-Horomanga Block, there being no objectors,, we recommend that the sai-d ten persons be added to the list of owners of the main block for the forty-eight shares asked for, and that the interest of Te Wakaunua Houpepe, No. 171 in the order, be reduced to nine shares, and the interest of Te Korowhiti Hira, No. 242, to nine shares, and the interest of Te Pouwhare te Roau, No. 258, be reduced to four shares, the three above-mentioned persons at their own request each contributing one share from their respective individual interests to provide an interest of three shares for Maria Tote. Appeals Nog. 1, 7, and 9. —These three appeals were withdrawn by the appellants, all parties consenting: we recommend that they be dismissed. The new lists of names marked "A," which have been attached to the order, contain the names and shares of the persons recommended to be added to the list of owners for each of the several pieces of this block above specified. The seven persons whose names are hereunder set out are the persons who have been selected by the owners of the land from amongst their number and proposed by them as the members for the Hapu Committee for this block, and agreed to by all the owners present before this Commission sitting at Te Whaiti on the 23rd day of March, 1907. 1. Pahatbnb Ngata. lerenui-Ohaua Block. Appeal No. IJ/.. —By Te Waaka Paraone te Ranui and others. This appeal was withdrawn by the appellant on the Bth January, 1907. Appeal No. 15. —8y Te Iwikino Hairuha and others. This appeal was withdrawn by the appellant on the sth February, 1907. We therefore recommend that appeals 14 and 15 be dismissed. Appeals Nos. 12 and 13. —By Numia Kereru and others, asking that a portion of this block said to be properly a part of Maungapohatu Block, which was wrongfully included in lerenuiOhaua Block, be cut off therefrom and restored to Maungapohatu Block. No objection was made to this claim. We therefore recommend that this appeal be given effect to, and that the portion claimed by Numia be cut off from lerenui-Ohaua Block and added.to Maungapohatu Block, the boundaries of the said piece to follow the lines drawn in pencil on Plan No. 6852a, commencing at figure 1 and extending to figure 3. Appeal No. 16.—8y Te Pouwhare te Roau and others, objecting to the names of eighty-eight persons in the order. A great deal of evidence was given before this Commission in regard to this case, and we have seen that these same objections were advanced at the time of the previous Commission, as each of the two contesting cases then opposing each other objected to each other's list of names respectively, and during the present hearing nothing new has been advanced. We therefore recommend that the persons objected to remain in possession of the shares awarded to them by last Commission, and that this appeal be dismissed. Appeal No. 11.— By Tamehana te Puia and others, claiming inclusion of the names of fiftyone additional persons in the order. A mass of evidence was advanced in support of this claim. We are however, of opinion that the evidence does not disclose any occupation on the part of the persons' sought to be included of a sufficiently permanent character to justify the inclusion of their names in the order. We therefore recommend that this appeal be dismissed, and that the original list of owners and shares as appearing in the order be affirmed, but that the award of last Commission be varied by the cutting-out of that specified portion of this block above recommended to be added to Maungapohatu Block, and that the boundaries and area of this block be amended accordingly. , , The seven persons whose names are hereunder set out are the persons who have been selected from amongst their number by the owners of the land and proposed by them as the members for the Hapu Committee for this block, and agreed to by all the owners present before this Commission sitting at Whakatane on the Bth day of March, 1907: — 1.
