Hurae Puketapu himself states that he waited and waited for Te Haenga Paretipua to arrive and present a list of names of his party, but that Te Haenga never came to either of the sittings of the previous Commission held at Te Waimako and at Te Whaiti. All these facts taken together lead us to recommend that the list of the descendants of Te Kapuamatotoru and all those of that party should be included in the land. We have therefore prepared and attached to the file of Waikaremoana Block a list of their names, numbered from 788 to 905, inclusive, with individual shares as shown therein, for inclusion in the order. This list also contains the list of names of Rakera te Apatu and other persons who have been included therein by the Commissioners, as they have one and the same right together with Te Haenga and his party, and the individual shares set opposite their respective names in the said list have been duly considered and fixed by this Commission. We recommend that these names and shares be added to the order. Appeal No. 82. —By Waaka Paraone te Ranui and others, claiming the inclusion of the names of thirty-four persons. This case and the case of the person opposing it was duly inquired into by this Commission and heard to its conclusion, and after due deliberation we are of opinion that the evidence put forward in support of this claim is not sufficient to establish occupation of such a character as would entitle them to be included. We therefore recommend that the list of thirty-four persons submitted under this appeal be disallowed, and the appeal dismissed. Wi Pere's Case. —A list of names of the members of the Ngati Whareanga Hapu was submitted by Wi Pere to this Commission at Whakatane on the 21st January, 1907, for inclusion in that portion of Waikaremoana Block named Whanganui-o-Parua, under his Appeal No. 35, which will be found amongst the appeals in reference to Maungapohatu Block. This list contains the names of eighty-six persons in all, and is marked with the letter " Q." These names and shares were read out by this Commission on the day they were submitted, and objected to on that day by Numia Kereru, together with other lists of names submitted by Wi Pere for inclusion in other portions of the land. No separate witness, however, appeared before us to give evidence of occupation on .the part of the persons in this list. Apart from the general evidence given by Wi Pere in regard to the main Ngati Kahungunu tribal boundary, and its internal subdivisional boundaries, there is nothing whatever to guide us. We are consequently unable to form an opinion as to whether these people have or have not rights to the land, seeing that no evidence of occupation on their part was advanced before us. We have therefore no recommendation to make in regard to this list. We recommend that the order for Waikaremoana Block be amended in accordance with the several recommendations made under the respective appeals in regard thereto above set out. The seven persons whose names are hereunder set out are the persons who have been selected by the owners of the land from amongst their number and proposed by them as the members for the Hapu Committee for this block, and agreed to by all the owners present before this Commission sitting at Te Whaiti on the 22nd day of March, 1907: — 1. Appeals Nos. 86 and 88. —By Taihakoa Poniwahio and others; and Appeals Nos. 89 and 90. —8y Erueti Tamaikoha. These four appeals ask for the inclusion of certain alleged rightful owners in this land, and that the land be divided into two portions, the dividing boundary to be the Te Waiiti Stream as shown in the plan, that part north of the said stream to be called Paraoanui North, the owners for the said northern portion to be the persons whose names appear in the original order for Paraoanui Block, numbered from 1 to 115, inclusive, together with the additional list of nineteen new persons submitted for inclusion, and numbered from 116 to 134, inclusive; the individual shares of the 115 persons in the order to remain as shown therein, and the shares of the nineteen additional owners to be as set out in the list of their names attached to the file, the area of the said northern portion of this land being 3,400 acres, more or less. The portion of the Paraoanui Block lying to the south of Te Waiiti Stream to be called Baraoanui South, the owners to be the same 115 persons contained in the original order for Paraoanui Block with shares as therein shown, together with the additional nineteen persons above mentioned, numbered from 116 to 134, inclusive, in the manuscript list attached to the file with shares as therein shown, and the names of the further 206 persons submitted for inclusion in this portion of the block, numbered respectively from 135 to 340, inclusive, in the list attached to the file, with individual shares as shown therein, the area of the said southern portion being 5,510 acres, more or less. No objection whatever has been advanced to this arrangement. We recommend that the mutual arrangement, agreed upon by the owners as above set out, be adopted, and that the order be amended, and the block partitioned in accordance therewith. Appeal No. 87. —8y Taihakoa Poniwahio and others. This appeal was withdrawn by appellant, there being no objectors. We recommend that it be dismissed accordingly. ■
