From these comparative genealogical lines it is evident that the persons mentioned in connection with this alleged gift could not possibly have lived during the same generation. In regard to the occupation, it is admitted that Ngati Tawhaki lived on this land at the time when all the hapus of Tuhoe Tribe assembled and lived together at Ruatahuna for mutual protection during the fighting-times in former days. It is in our opinion most clearly apparent that this claim is entirely unjustified. We therefore recommend that the list of names submitted for inclusion thereunder be disallowed, and the appeal dismissed. We further recommend that the south-eastern boundary of Ruatahuna Block be amended — and the area of the block corrected in accordance with such amendment—to follow the amended south-eastern boundary as shown on the plan. The seven persons whose names are hereunder set out are the persons who have been selected by the owners of the land from amongst their number, and proposed by them to be the members for the Hapu Committee for this block, and agreed to by all the owners present before this Commission sitting at Whakatane on the Bth day of March, 1907: — 1. Omahuru Block. Appeal No. 119. —8y Mika te Tawhao and others, claiming inclusion of six additional persons. Appeal No. 120. —8y Ereatara Heremia and another, claiming inclusion of eleven additional persons. There being no objectors to either of these appeals, we have prepared and attached to the file a list of their seventeen names, numbered from 238 to 254, inclusive, witli individual shares as shown therein, and we recommend that the said names and shares be added to the order. Appeal No. 117.— 8γ Te Wharau Tapuae. Appeals Nos. 118 and 121. —By Te Hapuku Hopa. These three appeals were withdrawn on behalf of appellants by Te Wharau Tapuae, there being no objectors. We recommend that they be dismissed. Appeal No. 122. —8y Te Waaka Paraone te Ranui. This appeal was left by the appellant in charge of certain persons appointed by him on the Bth January, 1907. No one, however, appeared before us to ask that this case be taken, from the date mentioned until the conclusion of the sitting of the Commission at Te Wh'aiti on the 28th day of March, 1907. We therefore recommend that this appeal be dismissed. We have prepared and attached a list of their names, numbered from 564 to 566, inclusive, to the file of papers for this block, with individual shares as shown theiein, and we recommend that the said names and shares be added to the order.
