AIELBOURNE, This day. At tlio liearing of the cliarge against Herbert Yincent, third offieer ot tlie Kaituna, that he failed in his duty and disregarded tlie collision regulations on the niglit of Alnrch 29. a novel point was raised for tlio defenee. A collision ooccurred between tlie. Kaituna and the Norwegian steamer Selje, the latter sinking immediately and tlie Kaituna wa.s badlv damaged at hcr bows. At the Afarino Court inquiry the Kaituna was1 hlamod. her master, Captain Sizer, and the third otfieer, being held responsible. ATr Yincont's counsol now points out that a passage in the Alarine Court 's finding, incorpoi*ated in a statement of the facls prosented in this case, dealt with Ihe eoursrs of the two ships, and the effect was that ono of them passed nvor dry land, inland from Cape Nei'son. The court deferred consideration.
