ALLEGED FALSE PRETENCES.

ROWELL AGAIN BEFORE THE . COURT. At the S.M. Court yesterdav morning, before Mr. W. A. Barton, S.M., William IJowell was charged with intent to defraud by means of a cheque, dated April sth, drawn on tho Bank of New South Wales, and by which he did obtain the sum Of £1 15s from Walter 'Ewan.

Detective Rawle conducted the prosecution, and accused was represented by Mr. H. Bright. Walter Ewan, purser on the U.S.S. Waikare,' stated that On April sth lie was requested by a man named Gunbolt to accept his friend’s cheque. Witness agreed to do so, and accused wrote out the cheque, for which he received a ticket. On arrival in Wellington, witness paid the cheque into the office of the company. The. cheque produced was the one he had received from accused.

Edgar Leonard Maude gave evidence as to having personally delivered a letter to tho accused on February 25 from Messrs Nolan and Skeet. Frederick Parker,- manage of the Bank of New South Wales, stated that he wrote to the accused on February 24, withdrawing his limit, and stating that any further debit operations would require to be provided for. Accused’s account was not closed. A Mr. Andrews saw witness on April 13th, and said that he desired to pay certain money into accused’s account to meet cheques which were then ,in circulation. Witness accepted the money, and placed it to liis No. 2 account, handing the cheques to Andrews. If lie had not known that accused was leaving the district tho amount would have been placed to the credit of liis account.

Henry John Andrews, bootmaker, stated that accused told him on February 11th that he had issued three cheques, and was anxious that the money to meet them be placed in the bank. Witness was not informed as to the 6tate of accused’s account. He paid the money into tho bank as requested by accused. His Worship held that there was not. sufficient evidence to sustain a conviction, and accused would accordingly be discharged. On a further charge of having obtained £lO from W. S. Spear by means of false pretences, accused was remanded until Wednesday, June 3rd. •
