BOROUGH COUNCIL V. MAYOR, HIS WORSHIP IN THE WRONG. ' [Press Association.] WELLINGTON, June 19. An important decision was given ill to-day’s Court by Mr. Justice Cooper in the case of 'Corporation of Danneyirlce v. Mayor of Daiinevrike, an action for a mandamus to compel the Mayor to put certain motions to the Council, which he had refused to do. His Honor held that the action of the Alivor in relation to the two motions was ultra vires. He made an order for a mandamus, and allowed 14 days for notice of appeal. If notice of appeal is given proceedings will he stayed pending the Court of Appeal’s decision.
