Plaintiff claims that lie agreed with Asher to take 5 per cent of the team’s gate money and divide the commission with Asher for the latter’s part in completing the arrangements. Asher, in a letter, is alleged to have offered Jack 2] per cent of the team’s share of the first gate money, but never agreed to pay commission. Defendant was allowed twenty days to enter an appearance to the suit.
