Evidence was taken by Mr. \V. A. Barton, S.M., yesterday morning in tho Auckland case of T, C. Wallace v. M. McElwain, a. claim for painting, ote. Tlio evidence"taken was that of Frederick Charles Webb .who had a sub-contract from tho plaintiff in connection with work done on defendant's ‘promises. Mr. ,T. A. Coleman appeared for tlio plaintiff, and Mr. J .. Blair for tho defendant. Counsel complained that tho witness . was apparently trying to evade giving a straight answer time and again, and this action on his part called forth tlio wrath of His Worship, who, at different times during tho hearing, characterised him as “a most extraordinary witness,” “a very troublesome witness,” and “tlio worst witness I liavo had before mo for some time.” Onco again mention was made in tlio Magistrate’s Court yesterday of tlio long-standing case of Win. Webb and Sons v. Hallenstcin Bros, and Brownlee. Mr. Harold Bright, for the plaintiffs, asked for a further adjournment, but Mr. J. W. Nolan, who appeared for tlio defendants,’ strongly objected to this course being followed. ITo pointed ■ out that lie bad a witness in Court from Christchurch, and the same witness had been hero on a previous occasion when the case had beon adjourned. His Worship suggested that the evidence of the witness might be taken, but again Mr. Nolan objected, stating that ’ho was strongly opposed to tlio evidence for tho defence, being taken before that of the plaintiffs. Ho would agree to an adjournment if cost® were allowed. After further argument Mr. Bright accepted the proposition for adjournment until Monday, 25th inst., plaintiffs to pay £9 18s costs.
Sitting in civil jurisdiction yesterday, Mr. W. A. Barton, S.M., gave judgment for plaintiff in the follow/ ing cases: Graco Boag (Mr. Finn) y. John McNeill, claim £3 2s 6d, with costs 10s; same v. Frank McNeill, claim £2’ss, and costs 10s; A. Parnell and Co. v. Gerald Tait Bartlett, claim £2 17s lid, costs ss; O. Morse (Mr. T. Alston Coleman) v. Charles Forbes, claim 14s 6d, costs 5 ;Robort Robertson (Mr. Blair) v. George Povreal, claim £2 16s, costs 10s (by consent). In the judgment summons case of James Erslcino (Mr. Blair) v. George Poulgrain, an order was made for tlio immediate payment of the balance owing, £l3 13s, in default 14 days imprisonment. Tho case of W. A. O’Meara, (Mr. Hei) v. John Henry Bell (Mr. Finn) was taken for rehearing, and, after listening to tho evidence of defendant, who stated that lio had only earned 11s since July last, His Worship dismissed the summons. A number of other oases were oither struck out or adjourned.
