MOTOR CAR AND BUTCHER’S CART.

CROSS ACTION

[Press Association.]

NAPIER, Nov. 2-J

Mr. Brabant, S.M., gave his reserved judgment to-day in the case arising out of a collision, between a motorcar and a butcher’s cart, which occurred at night recently on the Awatoto road, near Napier. H. H. Pliarazyn, owner and driver of the motor-car, which was damaged, obtained judgment against John Higgins, owner of the butcher’s cart, for £55 and costs. Norman Main, one of the occupants of the motor-car, obtained judgment for £7B 6s and costs against, the same defendant on account of personal injuries sufferd in the accident. On a counter-claim by Higgins against Pharazyn for damage done to the butcher’s cart, judgment was given for Pharazyn with costs. The Magistrate held that the accident was due to the defendant's servant or servants driving without lights.
