ALLEGED BREACH OF BY-LAW.

RIDING ON THE FOOTPATH.

AN INFORMATION DISMISSED

At the Magistrate's Court yesterday morning, before Mr W. A. Barton, tS.M., Herbert Frederick Gusli was charged with having, on December 2b, ridden a horse on the footpath in Palmerston road. Sergt. Hutton, conducted the prosecution and Mr H. J. .Finn appeared for defendant. Constable'Scott said tln.it he was on duty in Palmerston road on' the night of December 26th. He saw defendant sitting on a horse, which was standing across the footpath. Defendant was talking to a nlm over the fence and when they saw witness coming, the man inside the fence opened the gate and defendant rode inside. Later on, defendant came to witness and mid: “Mr Scott, I was only standing on the footpath for a few seconds. Wo .were talking about the Burns—Johnson fight.” To Mr Finn : There was a double gate leading into the premises and there was a properly formed footway on the crossing.

Herbert Frederick Gush suid that on the occasion he was riding a young •horse and tried to open the gate, but his horse would not remain quiet. He called to Mr Boyd to open the gate, and as soon as he did so, defendant rode into the premises, lie was net on the pootpatb more than half’-a-minute.

To Sergt. Hutton : When he firstsaw Const-. Scott he was about 200yds. away. Bernard Boyd, laundry proprietor said that when defendant was on the footpath on the horse he was only there for about ha-lf-a-minute. Defendant was trying to open the gate, and no conversation took place before defendant came inside. His Worship said that- it was quite clear defendant had not been on the footpath for an unnecessarily long time. The information would be dismissed.
