A NAPIER CASE

NAPIER, April 28. At the Magistrate’s Court yesterday, E. N. F. Gohns,' Inspector of Awards, sought to recover >a penalty from Bull Bros., building contractors, ,for a breach of award in dismissing H. A. King, a painter, from their employ because he was secretary of the Napier Painters-' and . Decorators’ Industrial Union of Workers. Mr. McCarthy, S.M., in giving judgment, said the defendants were building a house on the percentage basis for Mr. 11. L. McHafdy, who retained the right of sending off any man lie was not satisfied with. Defendants had wrongly assumed that the turning off by Mr. MoHardy was tantamount to dismissal from their employment. The onus lay on defendants to show that the man was not dismissed simply because he was a unionist and. occupied the position of secretary of the union. . Mr. Gohns said the department did not ask for the maximum penalty. His Worship, imposed a fine of £5 and costs 10s.
