CLAIM FOR WAGES.
—— JUDGMENT FOR DEFENDANT
At the Magistrate’s Court yesterday mbrning Gordon Aston (Mr T. A. Coleman) claimed 10s lor part of a week s waves, and £1 in lieu of notice of dismissal, from George Bannister (Mr h. T. Barnard)). . Gordon Aston, plaintiff, gave evidence that, in July ho got away for two days to attend races, with the consent of the defendant, witness- agreeing to coirio back and work overtime to make up the time lost. When he returned to work after the races the defendant said that as he had the two days oil lie might as well finish the week. Subsequently defendant obtained another man for his place, and refused to pay him the wages for the remainder of the week, giving him 10s, and not giving him notice of dismissal. Harry Aston, bookmaker, father of the plaintiff, gave evidence as to his gon saving he had got oft to attend the races. „ T , - j The defendant, George Bannister said that ho gave the plaintiff leave to attend the races, but did not think he would leave the shop till about H o’clock on the Thursday, and had no idea plaintiff did not intend to work on Thursday or Friday. As lie had been humbugged a great deal lie obtained another man m plaintiff s place. This ended the caee for the defence, and after Mr Coleman had briefly addressed the court, His Worship said lie did not think the plaintiff was entitled to take tlie days off, and therefore would not be able to recover. Judgment was accordingly given for defendant, there being no costs.
