The Appeal Court gave judgment 'today in the case of the Commissioner of Taxes v. the Nightcaps Coal Company, heard at the last sittings. The company claimed that the annual value of business premises to the extent of £785 should be deducted in assessing the income tax. The company claimed all its improvements as business premises, blit the magistrate who heard the objection excluded the railway, dwelling houses, and fencing. The appeal from the magistrate’s decision was allowed, with costs.
