WORKMEN’S COMPENSATION
AN UNUSUAL CASE. [Pku I’uesb Association.'[ NAPIER, Nov. 5. A rather unusual case was dealt wit'll at-the sitting of the Arbitration Court at Napier yesterday, on a motion for the amendment of an order for the payment of one penny per week to Timothy McCarthy by Messrs W. Ross and Son, Port AhurfrT. McCarthy met with an accident on March 29th, 1905. while in the employment of Messrs Ross and Sons, ropemakers, Port Ahuriri. At the time of his accident he was earning £1 per week, and he was awarded 10s a week compensation by the Court, but in 1907 he qualified himself to take a bookkeeper’s position, earning £1 a week. This matter had been brought before the Court by the respondents, who applied that they should he relieved of the payment of compensation, as the respondent "was earning £1 a week. He was not entitled to further compensation, but in order to keep his award in force the Court made an order that he should receive a penny a week. This had been paid to him, but recently he had formed the habit (counsel stated) of calling at the office of the accident insurance company every week and demanding payment of his penny in the most insolent manner. His manner had become so insulting that the company could not further tolerate it, and they asked that the Court should now make an order for the payment of a lump sum, or that the payment of a penny a week should be made annually or quarterly. The insurance company offered a lunm sum of £SO to settle the claim, but. his McCarthy was not disposed to accept. An adjournment was made to see if the parties could come to some arrangement, but on the Court resuming the position was the same. After some argument, however, McCarthy agreed to accept the lump sum offered, and an order was made accordingly to cancel the liability. A case In which, a lumper named John Alexander Campbell claimed compensation for injuries from Messrs "White and Tonkin, lightermen, was settled, out of Court" by the payment of £230 10s by respondents.
