BREACH OF BY-LAWS.

LIGHTING A FIRE WITHOUT A PERMIT. At the Magistrate’s Court on Saturday morning, before Mr. W. A. Barton, S.M., George Sims, who had been charged on Saturday with a- breach of the borough by-laws, in connection with a fire in the yard of Isr. Schumacher’s late residence, the case having been dismissed on technical points, was charged with lighting a fire in the open, jn the borough, on the 4th inst., without special permission of the Town Clerk. Mr. Bnrnard appeared for defendant, and entered a. plea of not guilty. Constable Moore gave evidence as to the fire having taken place, and Thomas Morrison, a Borough Council employee, stated that he saw the blaze at 11 p.m. on the date mentioned. Defendant was there, and witness warned him that he would get into trouble. Defendant went on burning, and said there was a valuable horse in the yard, and it was necessary to burn the straw. To Mr. Bnrnard: Witness could not have prevented the fireboll being rung. R. D. B. Robinson, Town Clerk, stated that no permit was issued for the occasion. Permits were only issued for fires in the daytime. Sergeant Hutton also gave evidence. Dr. Schumacher deposed that the straw was burned for the sake of the safetv of a horse that was in the yard. An effort had been made to have the horse stabled, but this could not ho arranged. • ~ His Worship said it was unreasonable to suppose that. fires could bd light without a permit, so he inflicted a fine of £l, with Is costs.
