W! PERE TRUSTEES V. BARKER BROS. CLAIM foi\ sheep. It will be recalled that on Saturday Mr W. A. Barton, S.M., non-suited Barker Bros. (Mr Stock) 1 in, their claim against the Wd Pere Trustees (Mr Rees) for the return of 347 sheep or their value, £2OO-. The case arose out of the sale of the Poututu estate from defendants to plaintiffs.
At the Magistrate’s Court yesterday the .Wi" Pere Trustees brought an action against Barker Bros, (for the return of 70 sheep and 1 six lambs, 'which it was alleged were not included in the number sold to defendants when .they purchased the estate. The value of the sheep was set out in the statement of claim as £4l 9s. .Mr Rees isaid that Mr Stock would give an under talcing that the sheep would he returned, and when the sheep were mustered for dipping, Mr Hiwgston the. late manager of the estate, would be dully notified.
Air Stock said that as the sheep came to harm they .would .be returned. They had to he mustered for dipping in Alarc.li, and ho would undertake to 'return the sheen.
3 he .Magistrate said that he thought the better course would be to adjourn the case till! April 6th, and the question of costs could stand over till. then. Counsel 1 agreed to this course, and tire case was accordingly adjourned till that date.
