MOKAU JONES’ ESTATE.
FURTHER COURT PROCEEDINGS. ARGUMENT BY MR. JELLICOE. iPER PRESS ASSOCIATION.! WELLINGTON, May 30. The affairs of Mr. Joshua Jones, of Mokau, farmer, were before the Chief Justice to-day, when liis counsel, Mr. E. G. Jellicoe, mentioned the claim! of £1,000,000 preferred by Mr Jones against- the executors of Mr. Wickham Flower. Counsel made a very long statement reviewing the history of the estate. “The executors,” he said, “had an attomev in New Zealand, and he desired to take proceedings. Some of the property was sold to- Mr. Herman. Lewis for £14,000, but he auestioned this sale, and plaintiff claimed redemption of his -nroperty. His Honor said that if there had been 1 a breach of contract in .England, counsel could not proceed in New Zealand, but Mr. Jellicoe' disagreed . His Honor pointed out that the Full Court (five judges) had held that the sale was a proper one. He must be guided'by them, and plaintiff was met by this bar in law. He thought plaintiff could 'not claim damages in this •country. He was. asking the Supreme Court of New Zealand to issue- a writ against persons in England, where the contract was made and broken. Mr. Jellicoe said Ire had been told by a Chancery 7 Judge in Ensland that lie could sue in New Zealand. His Honor said lie would try and deliver judgment on Thursday . morning.
