AND A COMPENSATION’ CLAIM

Stubbs, coal miner, sued xhe New Zealand Goal and Oil Company for the payment of 23s a week from May 22gd until such a time as plaintiff was able to work. It was stated that on November 1910 plaintiff met with an accident in the defendant’s mine, caused by a fall of coal, which resulted in a scalp wound and bodily injuries, especially weakness. Defendants paid him till May 22nd, 1911. but then ceased payment. The defence was a denial of liability. Medical evidence showed that in December, 1910, plaintiff was sent to Dunedin Hospital for an operation to the knee joint. An operation had been performed in 1909, and in November 1910 plaintiff dislocated his knee. Dr. O’Neill afterwards said he was suffering from degeneration of the knee joint.
