THE INDER CASE.
PLAINTIFF NON-SUITED
[PER PEESS ASSOCIATION.] AUCKLAND, June 26. In the case of -Index* v. Inder, iix which Leah Lillian Index* -sought to i*ecover from her husband, Wm. E. Index*, of Gore, £IOO. alleged to be due under an agreement, by which defend-, ant covenanted to nay plaintiff £3 a" week, was continued' before Mr Kettle, S.M., this morning, Mr Singer appearing for plaintiff and Mr Denniston for defendant.
Further veidence was given by the previous female witness, under crossexamination by the Magistrate, as to the innocence of plaintiff’s relations with men name St-oddart and Wilson, whom she said she knew as bookmakers, and whose business with her and Mi*s Inder was purely related to a racehorse named Silken Rein, in which witness was interested.
This evidence was, in part, contradicted by Wilson, who'was re-swoi*n. Mr Denniston explained that Stoddart, who was in Christchurch, had forwarded a letter stating that he would give evidence there, hut was unwilling to come up to Auckland, besides which the prosecution were unwilling to bear the expense of bringing him up. Mr Singer applied for a nonsuit, and Mr Denniston asked for costs.
Mr Kettle said Mr Singer was wise. His Worship had woiidered all along why the proceedings had not been taken under the Destitute Persons’ Act. A non-suit was accordingly entered. with costs against plaintiff, the question of costs to be adjusted in Chambers in tlje event of a dispute.
