ACCOUNTS IN A ROAD-AIAIvING CONTRACT.

CLAIM FOR RESTITUTION OF £27

Dennis O’Grady, George Field, Samuel Pardoe, and Leonard Crosswell, road contractors, (A!r 4'. Alston Coleman) proceeded against George Alicbael Dault-on, coach driver, of Muriwai (Mr W. Nolan) at the Magistrate’s Court Yesterday morning, to recover £27 alleged to be wrongfully detained by defendant in respect- of a road-making contract- at Muriwai. The. defendant was authorised by the plaintiffs to receive on their behalf certain money from Air Carl Williams, but lie bad retained the £27 for a debt owing by one- Buckthouglit, which it was claimed he lui<| no legal right- to dx>. George Field, carrier, of Alangapapa said tliat ho and the other plaintiffs were -road contracting at Aluriwai in Afarcli last. He know a man named Septimus Buckthouglit, who had boon working on the same job prior t-o! March. Buck thought was not a- co-contractor with witness. At the begining of April, witness was at defendant’s store at Wairnkai. Ho and Ills co-contractors went- to the store in order to settle up accounts with defendant. At that time there was a balance coining to witness and his partners in respect of a road contract. Buckthouglit to him, and he_ asked Ran I ton, said there was £29 owing by them if they would pay it. Witness said if there was enough money coming to Buekthought out of the .job they would pay it. Buckthouglit had a sub-contract from witness and his mates.

By Air Nolan: O’Grady did most of the business in connection with the contract, and paid Biiekthought’s men while they wore on the job and had the managemut of the accounts in. connection wit'll the job. Ci'os,swell 1 told witness that Buckthouglit owed him money, about 18. Dan I ton drew the money for Faulkner’s job under witness and bis partners’ instructions, and the money from Air Carl AVilliams’ job was drawn m the same way. The case was then adjourned until Thursday next.
