Buff and Black ” in the Napier News, writing of the dispute between Mr Ellis and the Poverty Bay Turf Club, says Mr Cornford, Mr Ellis’ solicitor, wrote to the Gisborne club on the subject, and offered to have the matter settled by arbitration—refer the question to the Auckland* Metropolitan club. An answer was received this morning (Wednesday) to the effect that they declined the offer, and held that the decision of the stewards was final. Mr Ellis therefore instructed his solicitor to write to the Auckland metropolitan club, laying the whole facta of the case before them, and asking for an Opinion on the subject. The Auckland club was mentioned as arbitrator because the Gisborne club run under their rules and regulations. So far as the writer knows, the Auckland club’s rules do not permit of au acceptance or even nomination being received after the advertised time, and such being the case the Gisborne club was clearly iu the wrong for receiving the acceptance of Fitzjames after the acceptances for the second day's racing had been posted up. If is certainly not fair to horse owners to infringe the rules of racing in this barefaced fashion, and the club, by not courting the fullest enquiry, will have odium cast upon them from all quarters, and will besides gain a very unenviable reputation.
_ '* Hippo,” in the Napier Daily Telegraph, on the same subject, thinks the Bay Turf Club made a mistake in their answer to Mr Ellis’ letter. The Metropolitan club are bound by their rules to conAt eider the case, and give their decision, which must be final, and the Poverty Bay Turf Club will have to abide by it. The case is a hard one tor the Club, who will, the writer thinks, have to pay the stakes twice over, as by allowing Fitzjames to run they rendered themselves responsible for the stakes.
