An Interesting Racing Case.

HON. CAPTAIN RUSSELL INVOLVED IN A LAWSUIT. [eTANDARD SPECIAL CORRESPONDENT.] Napieb, last night. The Napier Park Racing Club sued Captain Russell, in theR.M. Court yesterday, for the recovery of £3B, lhe value of the stake in the hack race at the club’s meeting (which race was won by the defendant’s Vandiman). on the ground that Vandiman, being entered for the Wanganui Derby, was therefore not a hack. A good deal of evidence was taken, amongst which was the following definition of Hack, on a poster issued by the club:— “ Hack shall mean a horse that has never scared in a weight for age race, back races excepted, or that is nominated for the Derby, Oaks, Guineas, or St. ' Leger, at the lime of nomination." Counsel for the defendant contended, among other things, that she omission of the word ‘ not ’ befure the word • nominated ’ prevented the defendant's hoise being disqualified. Judgment was reserved.
