Auckland Supreme Court.

GISBORNE CASES, [from our own correspondent.] Auckland, last night. In the Auckland Supreme Court the following Gisborne cases were on for adjudication :— Karaiti.na v. Bennett and others.—Mr Bees moved for the appointment of an interim trustee in Karaitiana’s estate. He thought Albert Karaitiana, being now of age, might be appointed. Mr Hesketh objected to the proposed appointment, and stated that his clients, the present trustees, wish the Public Trustee to be appointed. Mr Rees said there was a personal objection to thp Gisborne Agent of the Public Trus'es. It was necessary that soma one having a personal interest in the estate should be at once appointed, as there were a number of large claims pressing on it. Mr Hesketh quoted authorities to show that it ia objectionable to appoint as sole trustee a beneficiary, especially where, as in this case, there is another person benefl ing under the will. His Honor said it certainly was rather objectionable. Mr Beea said be had no objection to the appoiniment of some such person as Mr Akroyd, of Gisborne. Eventually it was decided tbat tha matter should stand over till to morrow for counsel to try to agree on the person to be appointed. Matthews v. Craill and others Mr W. L. Rees moved for a writ of prohibition in order to faciliate the progress of civil easel. Ehrenfried v. Gleeson, (Auckland esse).— Mr Rees and Mr Button, who appeared on the other side, agreed that the cue should ba taken at the next Banco sitting after tha return of his Honor from south.

E. P. Joyce v. John Biurke, Town Cleric of Gisborne.—W. L. Rees moved on appeal that the judgment of rhe R.M. at Gisborne herein be reversed. By the consent of Mr Hoskeih, who appeared on the other side, thia case was treated similarly to the lait.
