LIE V. ALEXANDER. This case was heard before the Resident Magistrate at the last sitting, when plaintiff was non-suited, and he brought the case into the District Court to be heard by a jury of four. It was to recover the sum of £104 damages, alleged to have been sustained by plaintiff through defendant refusing to carry out the sale of 385 shares in the Specimen Hill Company, Boatman's, which plaintiff alleged had been placed in Mb hands by defendant for Bale. The defence was that the authority to sell was based on an undertaking on the part of plaintiff to send out to Boatman's for sanction before any sale was effected, and that he had not done so, and it was further alleged that the authority to sell had been revoked. For the plaintiff on the other hand, it was urged that though a letter had been received by him to that effect it did not arrive till the sale of the shares had been effected to Mr Brennan. The plaintiff could not complete the sale by handing over the shares, and had to purchase in order to do so at an advance of ss. per share, and hence this action. Mr Lynch appeared for the plaintiff, Messrs Jones and Perkins for the defence. The jury, after a patient hearing, returned a verdict for the defendant. The costs were assessed at £9 2s. The Court then adjourned till to-day.
