RESIDENT MAGISTRATES COURT.
Thursday, October 26th. (Before W. H. Revcll, Esq. R.M) Pizzy & Co., V. M'lnnis.— No appearance. Vaughan v. Williams, claim for L 5. money alleged to have been illegally retained. Mr Lynch appeared for defendant. Thomas Vaughan said he went into defendant's hotel on Monday last, and tendered him a cheque for Llo, requesting .■ him to lakoL4 out of it, that he (plaintiff) owed him. Defendant kept L 9, 3aying witness owed it to him. Cross-examined. Boarded at defendant's for a few days, and borrowed L 3 from him, which I wished to pay him when I tendered him the cheque. Walter illiams, lam an hotelkceper residing in Reefton. Defendant boarded with me and was indebted to me L 9. 3s. In September, 1881, he borrowed L 2 ; on tho 17th of the same month, Ll ; on the 19th, I 1 cash, and the balance was for meals. I produce my book showing the items, which were entered at the time by myself. Alexander McDowal was called and corroborated defendant's testimony. Case dismissed with coats. Garth v. Curnick. —Claim for goods sold aud delivered. No appearance of defendant. Judgment for the amount claimed a r id costs. Mr Jones appeared for the plaintiff. The Court then adjourned.
