WARDEN'S COURT.
Thursday, December 20th, 1883. (Before Mr Warden Revell.) APPLICATIONS. The Keep-it- Dark • Jorapany applied for permission to make a deviation in the course of their head race. The application was opposed by Thomas Lynch, on the ground that the deviation would encroach upon his land. Mr J. Lynch appeared for the company to support the application. The following evidence was taken : — Thomas \ ynch : I am the holder of an agricultural lease in the upper Inangahua, and the proposed deviation would eucroach upon ruy land. The race as proposed would be eight or nine feet on my land for a good few chains. Cross-examined : I do not produce my lease. I know the race would be on my ground by the lines laid off by the District Surveyor. It wds"M? *»ontgomerie and his men who put in the pegs on the 11th April last* Mr * ontgomerie did tell me he could not make either head or tail of • r Woolley's lines. He did ask me to point out my boundary, and I did so. The Warden said the objector having sworn that the proposed deviation would encroach upon his land, it would be for the applicants either to prove that the race would run outside objector's boundary, or make terms with him. The right of the company to carry the race along the old course would not entitle them to alter the line, and take it through Lynch 's laud. He suggested that the case should be adjourned so as to enable a survey to be made of the line. This course was accepted, and the case was adjourned till next Court day. William Hindrnarsh applied for section Nn. 1070, Dick and Lucas streets, town of Reef ton. — Granted. Joseph Thomas applied for a town section on the terrace, Reefton — Granted, subject to survey. Timothy \ioor: No appearance. J. M 'Bain applied to purchase section at apleston. Applicant gave evidence as to the nature and duration of occupancy for transmission to the Minister of Lands. Patrick Brennan applied on behalf of the Big River Extended Company for a machine site, irve acres in extent, at Big River. The Warden said as the Big River was a new district he could not grant such a large area. The application would be granted for two and a-half acres only. A number of Chinese applied for alluvial rights in the Blackwater district, in the vicinity of Barman's store, all of which were unopposed and granted. The Court then adjourned.
