SALE OF LAND.
COMPANY SUED. Per Press Association. HAMILTON, Dec. 8. At the Supremo Court, before HLs Honour Mr Justice lierdman and a special jury, a case is being heard in which Frederick Freeman Rogers, farmer, of To Awamutu, is suing the Matarawa Land Company, Ltd., for £IOOO damages as alleged misrepresentation in a sale of a farm at Tokoroa, near Putaruru. Over forty witnesses are being called and the case is likely to last till Friday. it is alleged in the statement of claim that, in 1920, the defendant company, being fully aware that the land was cattle sick and unsuitable for dairying, subdivided the land and offered it at auction as dairy farms. Two farms were sold at the sale, but after endeavouring to milk on their land for two seasons both farmers had abandoned the holdings on account of their heavy losses of stock through sickness. Four separate claims were set down for hearing against the company this session, but three could not be reached.
