JURY FAILS TO AGREE.
FRESH TRIAL ORDERED. Per Press Association. WELLINGTON, Dec. 7. In the Nevill trial for illegal use of an instrument, counsel addressed the Court at length. Mr Wilford asked that where there was any element of doubt, as he submitted there was in the present case, accused should be given the benefit. His Honour summed up, and the jury retired at 3.10 p.m. and returned four hours later to announce that they could not reach a decisipn. A fresh trial on the present charge was fixed for the February sessions. Another indictment will be proceeded with to-morrow. Mr P. S. Macassey prosecuted on behalf of the Crown, and Mr T. M. Wilford and Mr J. F. B. Stephenson appeared for the prisoner.
