HONOLULU MURDER.
... THE FORTESCUE CASE. NEW MOVES BY THE DEFENCE. Received January 30, 8.5 a.m. HONOLULU, Jam 28. A new move- to dismiss the indictment in the second degree for the murder of the Japanese youth, Kahahawai, who tyte last year was acquitted on a charge of criminally assaulting Mrs Massie, has been made in the- case against Mrs Fortescue and Lieutenant Massie, of the United States Navy. A supplementary motion was filed by the defence to-day objecting to the foreman’s action iri not permitting the Grand Jury to ask the county, attorney to draw an indictment ‘ for mansslaughter instead of murder. The defence later to-day entered a motion to admit defendants to bail, which will be heard to-morrow.
The Court has ordered all guns and cameras to be taken from everybody except law officers at the Courtroom door at all hearings in this case.
