FINE OF ONE SHILLING.

Per Press Association. NELSON, Dec. 19,

In giving decision in a case where James Gribben was charged with assaulting Arthur Ernest Alfred Wiffen, inflicting facial injuries necessitating four days in hospital, Mr T. E. Maunsell, S.M., said that the assault had not been denied, but the defence was one of extreme provocation. The Magistrate could not believe that the meeting between Wiffen and defendant’s wife in Wellington was a chance meeting. The Magistrate was also satisfied that Wiffen had broken up defendant’s home. It was not legal for Gribben to make the assault, but as long as human nature was what it was, that would be the natural result, and no law could stop it. The Magistrate said he would inflict a contemptuous penalty, so far as Wiffen was concerned. One shilling fine without costs was inflicted.
