APPEAL COURT.
HURLSTONE v. STEADMAN. Per Press Association. WELLINGTON, Aug. 2. The Appeal Court to-day dismissed the appeal in the case of Peter Percy Hurlstone v. Harold Oscar Steadman, heard on June 23. Appellant (Hurlstone) had brought an action in the Supreme Court to set aside judgment in a motor collision case in favour of respondent. This was refused by Mr Justice Callan, whose judgment was confirmed by the Chief Justice (Sir Michael Myers) and Mr Justice Kennedy and Mr Justice Northeroft. Mr Justice Ostler was of the opinion that the case should be remitted to the Supreme Court to determine whether as a question of fact the judgment in favour of respondent had been procured through his fraud. MACKENZIE v. HARPER. Per Press Association. WELLINGTON, Aug. 2. The Full Court to-day dismissed the. appeal in the case of William Mackenzie v. W. J. Harper, heard on July 1. The question of hotel licensees’ bona fide guests being on the premises during prohibited hours and, incidentally, supplying them with liquor was raised in this case Lillian Mackenzie, wife of appellant, was convicted and fined at Christchurch by Mr E. 0. Levvey, S.M., on a charge of supplying liquor after hours at Taker-nil's Hotel. Defendant pleaded not guilty. The Magistrate found as a fact that the persons .-upplied were at the time bona fido guests of Mrs Mackenzie. He was compelled to follow a Supreme Court decision in 1926 although he disagreed with it. The appeal was taken against this finding on the ground that it was crrcnecus in law.
